At present, there are certain popular .eu domaine names, such as sex.eu and business.eu, that are still not attributed to an owner.
First, Eurid had mandated Price Waterhouse Cooper for the validation of the cases, based on specific criteria (eg. valid Trademark, does the applicant have a link with the trademark, the format of the case, the credibility of the prove). If the case had been accepted, the domaine name was attributed to the applicant on a « first come, first served » base.
EURid has then given the opportunity to everyone to file a complaint concerning the attribution of a domaine name through either internal revisions, ADR procedures (Alternative Dispute Résolution), or legal action.
In that case, an analysis of the rights of each concerning party is done by a commission of experts, specialised in intellectual property. During this analysis, the final attribution remains on hold.
It is important to have an agent who can deal with the administrative complexity that such procedures involve. Therefore, it is essential to carefully select your agent before entering a case.
These days, this is again of large importance with the opening of the .asia extension.
