New extensions: the right of objection

The ICANN has chosen the date of May 1st to publish the full and official list of the extensions submitted in the frame of the new GTLDs program. Two important phases will follow this publication:
- From May 1st to june 30, 2012: dispute time. During this phase, anyone will be able to contest or simply comment the different approved extensions. Trademark holders will have the possibility to let the evaluation jury know how the allocation of an extension could have a negative impact on their image, for instance.
- From May 1st to November (the end of this period still isn't fixed): this phase is dedicated to trademark holders with objections. More than just a comment, trademark holders will have the possibility to officially object to the allocation of an extension if one of the following risks are involved:
• Confusion about the extension: if the concerned extension might be mistaken with the extension of the plaintiff.
• Legal Rights Objection: if the concerned extension represents a threat for the legal rights of the plaintiff.
• Limited Public Interest Objection: if the concerned extension goes against the public and moral order as it is defined on an international level.
• Community Objection: if the concerned extension is related to a community, who is against the allocation of this extension.

This special program has been organized by the ICANN in order to answer the needs of trademark holders, who were worried about their protection rights as the new gTLDs programm has been launched ; they submitted to the ICANN their wish to have the possibility to protect their trademarks against possible attacks to their trademark or image. With these two objections and comments process, their worries should be gone...
