Alternative Dispute Resolution for .fr and .re Domain Names by On-line Recommendation (CMAP). A requesting party may also initiate a WIPO procedure instead of or after filing a AFNIC procedure.
The World Intellectual Property Organization (WIPO), a specialized agency of the United Nations dedicated to developing a balanced and accessible international intellectual property (IP) system, provides the domain name dispute resolution services based on the Uniform Domain-Name Dispute-Resolution Policy (UDRP).
Relevant differences between the WIPO procedure for .fr and .re and the Uniform Domain Name Dispute Resolution Policy (UDRP) include that (i) whereas the UDRP is limited to the protection of trademark rights against infringement through bad-faith registration and use of a domain name, under the WIPO procedure for .fr and .re a Claimant must establish that the registration or use of the domain name constitutes an infringement of rights protected in France or Community rights, which may concern trademarks or any other types of intellectual property or other rights and (ii) no three-member panels are possible. |

Already 12 years that the AFNIC (French registry for Internet domain names) rules peacefully the universe of .FR domain names; the association decides for the registration rules, as well as for the domain names allocations etc. BUT: on October 6th, through a press release, the Constitutional Council ( French institute created under the fifth Republic which speaks and intervenes over the conformity of some laws or rules) has cancelled the law of 2004 on the attribution of domain names, as it was described in article L.45 of the French Electronic Communications Act. Would the Constitutional Council want to take the power out of the AFNIC’s “hands” over French domain names? Not exactly…

Special Information
We can register domain names on behalf of companies and private persons who have no presence in France. The representation contract implies that E-ZONE SAS is the legal owner of the domain name and that the client has all user rights over the domain name, including termination and transfer. In case of abuse or non respect of the General Conditions, as described by AFNIC, E-ZONE SAS has right to remove or transfer the domain name concerned.
The Client has to protect E-ZONE SAS against any act of fraud, related to the services delivered by E-ZONE SAS. As a consequence, the Client shall assist E-ZONE SAS in its defense and shall indemnify E-ZONE SAS for any damage resulting of such a complaint (i.e. judicial costs, indemnities, etc.)
